Welcome to Octopus Gary. These Terms of Service ("Terms") govern your access to and use of the website at octopusgary.com and related services (the "Service"). By accessing or using the Service, creating an account, or signing in with Google, email, or phone, you agree to these Terms.

If you do not agree, do not use the Service. Our Privacy Policy explains how we collect and use personal information.

1. The Service

Octopus Gary provides AI-assisted football predictions, match information, rankings, leaderboards, mini-leagues, and related entertainment and analysis features. The Service may change, expand, or be discontinued in whole or in part at any time.

2. Entertainment only — no gambling advice

All predictions, ratings, simulations, commentary, and related content are for entertainment and informational purposes only. Nothing on the Service constitutes betting, gambling, investment, or financial advice. You are solely responsible for any decisions you make based on content you see here.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Accounts and authentication

You may create or access an account using:

• Email and password;
• Google Sign-In (OAuth); or
• Phone number with a one-time passcode.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information and notify us promptly if you suspect unauthorised access. We may suspend or terminate accounts that appear compromised, abusive, or in breach of these Terms.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to accounts, systems, or data, or interfere with the Service's operation.
• Scrape, crawl, or bulk-extract content in a way that burdens our infrastructure or violates applicable law, except via documented public interfaces we expressly permit.
• Impersonate others, manipulate leaderboards or predictions through fraudulent means, or harass other users.
• Reverse engineer, copy, or redistribute proprietary models, branding, or content except as allowed by law or with our prior written consent.

6. User content and predictions

When you submit predictions, profile information, or other content ("User Content"), you retain ownership of that content. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, and use User Content as needed to operate and promote the Service (for example, showing your display name and predictions on leaderboards).

You represent that your User Content does not infringe others' rights and complies with these Terms. We may remove User Content that we reasonably believe violates these Terms or applicable law.

7. Intellectual property

The Service — including the Octopus Gary name and branding, Human Factor Rating™ and related marks, software, designs, and original content — is owned by us or our licensors and is protected by intellectual property laws. Except for the limited licence to use the Service as provided in these Terms, no rights are granted to you.

8. Third-party services

The Service may rely on third parties such as Google (for sign-in), hosting and database providers, and email delivery services. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that predictions will be accurate, that the Service will be uninterrupted or error-free, or that any content is complete or current.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTOPUS GARY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You agree to indemnify and hold harmless Octopus Gary and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws applicable in the jurisdiction where the Service operator is established, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply.
